Howard Lane Bld. 1, Suite 100, Austin, TX 78728, respects your privacy and provides you with this Privacy Policy (“Privacy Policy”) so that you may understand the ways in which we, acting as a data controller under the GDPR, do and do not use the information you transmit when accessing and using the website, platforms, software services, and related services (hereinafter the “Website” and “Services” respectively).  

Please note that confirmation of having read and understood this Privacy Policy (and confirmation of acceptance of our Terms of Use) is required to access and use the Website. 

Definitions 

“Applicable Data Protection Legislation” means any legislation in force from time to time, including the General Data Protection Regulation (“GDPR”) 2016/679 of April 27th, 2016, such legislation which implements Directive 2002/58/EC and all other applicable laws and regulations that may apply to the processing of Personal Data.

“Service Data” means any Party’s Personal Data (that is not Contact Data) held within the Parties’ systems, applications or databases and that may be accessed, processed, used or stored as a consequence of performing the services under the applicable agreement.  

“Third Country” means a country that is: (i) outside of the European Economic Area; and (ii) not the subject of a formal decision by the European Commission, made pursuant to Article 45 (1) of the GDPR, stating that that country ensures an adequate level of protection for personal Data.

  • Ensure that their employees, as well as employees of their affiliates and subcontractors involved in the performance of agreements with you, adhere to the provisions of the agreement.
  • Implement all reasonable technical and organizational measures to safeguard your Personal Data against accidental or unlawful destruction, loss, unauthorized alteration, communication, or access.

Information Shared with Third Parties

To fulfill the contract between Salient Systems and you, including providing you with Website Services, your Personal Data may be processed on servers located outside your country of residence. Regardless of server location, we implement appropriate measures to safeguard your rights in accordance with this Privacy Policy. 

Notwithstanding the above, we may share information about you with certain third parties based on the legal bases outlined in Articles 6(1)(a), 6(1)(b), 6(1)(c), and 6(1)(f) of the GDPR as follows: 

– Third-Party Agents and Contractors:  

We may share information about you with third-party agents and contractors to provide Website services, for ongoing development, analytical purposes, backtrace crash reporting analysis functionality, etc. Information will only be provided to such third-party agents and contractors for the performance of their specific tasks for us and in accordance with this Privacy Policy, and not for any other purposes. It is ensured that such third-party agents and contractors maintain an adequate level of protection of Personal Data in accordance with all Applicable Data Protection Legislation and/or through agreements with us. 

– Third Parties:  

When required by applicable law, rule, regulation, legal process, during negotiations of mergers and acquisitions, sale of company assets, financing, or acquisition of all or a portion of our business by another company, where Personal Data submitted to us may be transferred to the acquiring entity. 

– Courts, Law Enforcement Agencies, Legal Authorities, etc.:  

When ordered or requested by courts, legal authorities, etc., and necessary for us to comply with applicable laws, or to protect our rights, in defense in lawsuits, property, or safety of Salient Systems, the Website, end users, etc. 

– Analytics:  

If a user voluntarily shares their website usage data with us to enhance the user experience, their data will be anonymously shared with our analytics platforms. Users can opt-out at any time. 

Payment Information

Salient Systems adheres to strict data protection measures, including not retaining credit card information. We do not sell, transfer, or share customer data with third parties unless necessary for the operation of our business. In instances where information is required for specific services, such as order processing and payment handling, it may be transferred to third-party agents. 

To access premium website functions, cosmetic items, and features, users may need to pay fees. During such transactions, platform/service providers, including PayPal, may request Personal Data like full name, billing address, email address, and credit card information. It’s important to note that users must be of legal age as per their country’s laws to make purchases. Minors may access and use the website with parental or legal guardian consent. 

Upon successful entry of credit card information and completion of the order process, a purchasing account will be established and maintained. The platform/service providers, including PayPal, will utilize the provided information to process orders, send email order confirmations, facilitate future purchases, and manage refunds, ensuring a seamless customer experience while safeguarding sensitive data. Salient Systems is dedicated to safeguarding and preserving your privacy. We have implemented appropriate measures to protect the Personal Data we collect, ensuring its confidentiality, security, and integrity. Personal Data is stored in secure operating environments that are inaccessible to the public and are only accessible to authorized employees and contractors. We have also established security protocols to prevent the loss, misuse, and alteration of the information under our control. However, it’s important to note that perfect security does not exist. While we strive to protect Personal Data, we cannot guarantee the security of any information transmitted to us through or in connection with the Website, stored on our systems, or stored on our service providers’ systems.

Removed information may persist in backup copies for a reasonable period but will not be generally available to other users.

We will process and respond to your requests without undue delay and in any event within one month of receiving the request, unless a longer period is required due to the complexity of the request. In such cases, our response time may be up to three months, as permitted by Article 12 of the GDPR. 

You may exercise rights related to the protection of personal information by requesting access to your personal information or the correction, deletion or suspension of processing of your personal information, etc. pursuant to applicable laws such as the Personal Information Protection Act (“PIPA”). You may also exercise these rights through your legal guardian or someone who has been authorized by you to exercise the right. However, in this case, you must submit a power of attorney to us in accordance with the Enforcement Regulations of the PIPA. You can also withdraw your consent or demand a suspension of the personal information processing at any time. 

Additional Use and Provision of Personal Information  

In accordance with the PIPA, we may use or provide personal information within the scope of reasonably r elated to the initial purpose of the collection, in consideration of whether disadvantages have been caused to data subjects and whether necessary measures have been taken to secure such as encryption, etc. We will determine with due care whether to use or provide personal information in consideration of general circumstances including relevant laws and regulations such as the PIPA, purpose of use or provision of personal information, how personal information will be used or provided, items of personal information to be used or provided, matters to which data subjects provided consent or which were notified/disclosed to data subjects, impact on data subjects upon the use or provision, and measures taken to protect subject information. Specific considerations are as follows:   

  • whether the additional use/provision is related to the initial purpose of the collection;  
  • whether the additional use/provision is foreseeable in light of the circumstances under which personal information was collected and practices regarding processing;
